Important: These Terms should be read with Aesthete’s Privacy Policy, Returns Policy, Shipping Policy, Aftercare information and any service-specific consent or purchase terms.
1. About these Terms
These Terms and Conditions (“Terms”) govern your use of aesthetewellness.com.au and any associated online store, booking platform or digital service operated under the Aesthete Wellness name. They also set out important conditions that apply when you reserve an appointment, purchase a product, gift card, treatment, package or program, or receive services at an Aesthete location.
By using the website, making a reservation or completing a purchase, you agree to these Terms and any policy or consent document specifically provided to you in connection with a service. If you do not agree, you should not use the website or proceed with the relevant purchase or reservation.
2. Who We Are
Aesthete Wellness is a registered business name of T&J Irwin Holdings Pty Ltd. Depending on the location and the service selected, services may be supplied by T&J Irwin Holdings Pty Ltd trading as Aesthete Wellness, Aesthete Sunshine Coast, Aesthete Noosa, or an independent medical or allied health practitioner or entity practising from an Aesthete location.
In these Terms, “Aesthete”, “we”, “us” and “our” refer to the relevant Aesthete entity operating the website or supplying the applicable product, administrative service or clinic service. Where an independent practitioner or entity supplies healthcare directly, that provider is separately responsible for their professional advice, clinical decisions, treatment and outcomes. The identity of the relevant provider will be disclosed where required.
Aesthete currently operates in Maroochydore and is developing Aesthete Noosa. References to an “Aesthete location” include each current or future location operating under the Aesthete Wellness name.
3. General Information — Not Medical Advice
Content on this website is provided for general information and education only. It is not medical advice, a diagnosis, a treatment recommendation or a substitute for an individual consultation with an appropriately qualified health practitioner.
Treatment suitability, expected benefit, risk, downtime and cost vary between individuals. Website content, imagery, testimonials and descriptions must not be interpreted as a guarantee that a particular treatment is suitable for you or will produce a particular result. If you have an urgent medical concern, contact an appropriate medical service. In an emergency, call 000.
4. Eligibility and Accurate Information
Aesthete is an adult-only practice. Clinic appointments and treatment services are available only to people aged 18 years or older, unless Aesthete expressly agrees otherwise and the service is lawful and clinically appropriate.
You must provide complete, current and accurate information when making a reservation, completing forms, purchasing products or receiving care. This includes relevant medical history, medications, allergies, pregnancy or breastfeeding status, previous procedures and any change in your health. Withholding or providing inaccurate information may affect treatment suitability and safety and may result in a service being postponed or declined.
5. Consultations, Recommendations and Consent
A consultation may be required before treatment. A reservation does not guarantee that a requested treatment will be performed. Treatment will proceed only where the responsible practitioner considers it clinically appropriate and where all required consultation, cooling-off, prescribing, consent, photography and other professional or regulatory requirements have been completed.
Recommendations are based on the information available at the time of assessment. A treatment plan may change if your health, presentation, priorities or response to treatment changes, or if the responsible practitioner considers another pathway more appropriate.
Before treatment, you may be asked to sign a separate informed consent form. Those clinical consent terms operate in addition to these Terms. If there is an inconsistency concerning clinical care, the more specific consent or practitioner terms will apply to the extent permitted by law.
6. Independent Practitioners and Subcontracted Medical Entities
Aesthete may provide rooms, administration, reception, booking, payment collection, technology, records support or other practice services to independent medical or allied health practitioners and entities. These providers are not necessarily employees of Aesthete.
An independent provider remains professionally and legally responsible for the healthcare they personally provide, including assessment, prescribing, informed consent, treatment decisions, follow-up and clinical outcomes. Aesthete remains responsible for the services it separately supplies and nothing in these Terms excludes any responsibility that cannot lawfully be excluded.
Relevant information may be shared between Aesthete and the treating provider where reasonably necessary to arrange or support your care, manage records, process payment or meet legal and professional obligations. This occurs in accordance with Aesthete’s Privacy Policy and any applicable provider privacy notice.
7. Appointment Reservations and Fees
A $100 booking fee is required to secure every appointment. The booking fee must be paid at the time of reservation before the appointment is confirmed. The $100 booking fee is not an additional charge when you attend your appointment. It will be applied toward the amount payable for the consultation, treatment or service reserved, unless different terms are clearly disclosed before booking.
Some services, practitioners, packages or longer appointments may require full prepayment or a booking amount greater than $100. Any different payment requirement and the applicable conditions will be clearly communicated before the reservation is confirmed.
Unless otherwise stated, a consultation fee pays for the professional time, assessment and advice provided during the consultation. It is not a payment for a guaranteed treatment or outcome. Where a fee is described as redeemable, it may be applied only in the manner, timeframe and against the products or services stated at the time of reservation.
A reservation is confirmed only when all required details and the applicable booking fee, prepayment or card authorisation have been received. You are responsible for checking the date, time, location and practitioner shown in your confirmation.
8. Changes, Cancellations and Failure to Attend
At least 48 hours’ notice is required to cancel or reschedule an appointment, unless different conditions were clearly disclosed when the reservation was made. Notice must be given through the cancellation or rescheduling function in your booking confirmation, or by contacting Aesthete directly. Replies to an automated reminder may not be monitored. If you cancel or reschedule with less than 48 hours’ notice, fail to attend, or arrive too late for the reserved service to be safely or reasonably completed, your $100 booking fee will be forfeited.
The forfeited $100 booking fee constitutes the cancellation fee. It will not be credited, transferred or applied toward a future appointment. No additional cancellation fee will be charged for the same appointment unless a different condition was clearly disclosed and agreed to before the reservation was confirmed.
Where an appointment required a booking amount greater than $100, full prepayment or the use of a prepaid package, the cancellation conditions disclosed at the time of reservation will apply. Aesthete will not impose both forfeiture of the $100 booking fee and a separate late-cancellation fee for the same appointment unless an additional condition was clearly disclosed and agreed to before booking.
Appointment reminders are provided as a courtesy. You remain responsible for attending your appointment even if a reminder is delayed or not received. Where repeated late cancellations or failures to attend materially disrupt the practice, Aesthete may require full prepayment for future appointments or decline future reservations. Aesthete will act reasonably and consider the relevant circumstances.
If Aesthete or the treating provider needs to change or cancel an appointment, reasonable efforts will be made to offer another suitable time. Any amount paid for a service that cannot be supplied will be transferred, credited or refunded as required by law.
9. Arrival and Appointment Timing
Please arrive at the time requested in your confirmation and allow sufficient time for parking, forms, photography and preparation.
Late arrival may shorten the appointment, require the service to be modified, or result in the appointment being rescheduled where the service cannot be completed safely or without affecting other patients. If late arrival prevents the reserved service from proceeding, the $100 booking fee may be forfeited in accordance with the cancellation conditions in Section 8.
10. Prices, Payment and Card Authorisation
All prices are in Australian dollars and include GST where applicable. Prices, service inclusions and availability may change. The price confirmed at the time of purchase or reservation will apply, except where there is an obvious error or a change is required by law.
Payment is due at the time stated by Aesthete. Available payment methods may vary between the website and clinic. If a card is held to secure an appointment, you authorise Aesthete or its payment provider to charge an amount properly due under the cancellation terms disclosed to you.
Aesthete may correct genuine pricing or description errors. If an error affects an order already placed, you will be contacted and may choose to proceed at the correct price or cancel for a refund.
11. Treatment Packages, Programs and Clinic Credit
A treatment package, program, membership or clinic credit is subject to the inclusions, validity period, location, practitioner and other conditions disclosed at purchase. Unless otherwise stated, these benefits are personal to the named patient and cannot be transferred or exchanged for cash.
Treatments within a package remain subject to clinical assessment at each visit. If a planned service becomes unsuitable, Aesthete or the responsible practitioner will discuss clinically appropriate alternatives. Any credit, substitution or refund will be determined under the purchase terms and Australian Consumer Law.
Promotional inclusions, complimentary services and bonus value have no cash value unless required by law.
12. Gift Cards
Gift cards are valid for at least three (3) years from the date of supply, unless a lawful exception applies or a longer period is stated. The expiry date and any material restrictions will be displayed on or with the gift card.
Gift cards may be used for eligible products or services supplied by participating Aesthete locations, subject to treatment suitability and the conditions stated at purchase. They are not redeemable for cash and cannot be used to purchase another gift card, except where required by law.
Gift cards are generally non-refundable for change of mind and should be treated like cash. Aesthete is not responsible for a lost, stolen or unauthorisedly used gift card, but may choose to replace it where ownership and the remaining balance can be verified. No prohibited post-supply fee will be charged.
13. Product Orders, Delivery and Returns
Product availability is not guaranteed. Aesthete may limit quantities, decline or cancel an order where stock is unavailable, an error has occurred, fraud is suspected, or supply would be unlawful. If payment has been taken for an order that is cancelled, the applicable amount will be refunded.
Product images and colours are displayed as accurately as reasonably possible, but appearance may vary by device and packaging may change. Product information is not a substitute for professional advice, and you should follow the label and any directions provided.
Delivery estimates are indicative only and may be affected by circumstances outside Aesthete’s reasonable control. Ownership and risk pass as provided under the applicable shipping terms and law.
Returns, exchanges and remedies are governed by Aesthete’s Returns Policy and Australian Consumer Law. Change-of-mind returns may be declined, particularly for opened skincare, medicines, prescription products or goods that cannot be resold for health or hygiene reasons. This does not limit your rights where a product is faulty, unsafe, incorrectly described or otherwise fails a consumer guarantee.
14. Prescriptions and Dispensed Products
Prescription medicines and practitioner-only products are supplied only where authorised and clinically appropriate. A prescription, recommendation or prior use does not guarantee ongoing supply.
For safety and regulatory reasons, dispensed medicines cannot generally be returned or resupplied once they have left the practice, except where supplied incorrectly, defective, subject to recall or otherwise required by law. Questions about a prescription or adverse reaction should be directed promptly to the prescribing practitioner or dispensing pharmacy. Seek urgent medical assistance where necessary.
15. Results, Risks and Aftercare
Medicine, aesthetic procedures, laser and energy-based treatments, skin treatments and restorative services involve individual responses. Results, longevity, recovery and side effects vary and cannot be guaranteed. Published examples, treatment timelines and before-and-after images are illustrative only.
You are responsible for following preparation and aftercare instructions, attending recommended reviews and promptly reporting unexpected symptoms or concerns. Failure to follow instructions, undisclosed health information, external treatments, lifestyle factors or events outside the provider’s control may affect safety and outcomes.
Nothing in these Terms excludes or restricts any consumer guarantee, professional duty or other right or remedy that cannot lawfully be excluded.
16. Clinical Photography and Records
Clinical photographs or imaging may be required where reasonably necessary for assessment, treatment planning, patient identification, documentation, safety, review or professional record-keeping. If required clinical records cannot be obtained, a treatment may not be able to proceed.
Clinical images form part of the health record and are handled in accordance with applicable privacy and health-record requirements. They will not be used for advertising, social media, education or other promotional purposes without separate consent. Promotional consent is voluntary and may be withdrawn prospectively in accordance with the consent provided.
17. Conduct, Safety and Ending the Relationship
Aesthete is committed to a safe, respectful and professional environment. Abusive, threatening, discriminatory, sexually inappropriate, unsafe, intoxicated, fraudulent or unlawful conduct will not be accepted.
Aesthete or a practitioner may decline, postpone or discontinue a service or professional relationship where treatment is not clinically appropriate, trust has broken down, information has not been disclosed, accounts remain unpaid, policies are repeatedly breached, or safety or professional obligations require it. Where clinically appropriate and reasonably practicable, information about alternative care or continuity arrangements may be provided.
18. Website Use and Prohibited Conduct
You may use the website only for lawful, personal and non-commercial purposes. You must not interfere with its operation or security; introduce malicious code; scrape, harvest or misuse data; impersonate another person; make fraudulent reservations or purchases; infringe intellectual property or privacy rights; or use the website in a way that may harm Aesthete or another person.
Aesthete may restrict or terminate access to the website where these Terms are breached or where reasonably necessary to protect the website, patients, practitioners or business.
19. Intellectual Property
Unless otherwise stated, all website content including written content, treatment frameworks, terminology, graphics, imagery, branding and the Aesthete Method is owned by or licensed to the relevant Aesthete entity and is protected by copyright, trade mark and other intellectual property laws.
You may view and retain limited extracts for personal, non-commercial use. No content may otherwise be copied, reproduced, adapted, republished, distributed, framed, communicated, used to train or populate another commercial service, or exploited for commercial purposes without prior written permission, except as permitted by law.
20. Third-Party Platforms, Links and Services
The website may connect to services operated by third parties, including Shopify, Timely, payment providers, delivery providers and external websites. Those services may have their own terms and privacy practices.
Aesthete does not control third-party websites and is not responsible for their independent content, availability or conduct. A link does not necessarily indicate endorsement. Nothing in this clause limits responsibility for a third party acting as Aesthete’s agent where that responsibility cannot lawfully be excluded.
21. Privacy and Communications
Personal information is handled in accordance with Aesthete’s Privacy Policy and applicable law. By providing contact details, you consent to receiving transactional communications reasonably required to manage reservations, purchases, care, recalls, safety information and accounts.
Marketing communications are sent only where permitted. You may unsubscribe from marketing at any time, although this will not prevent necessary service or clinical communications.
22. Consumer Guarantees and Liability
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any right, guarantee, remedy, professional obligation or liability where doing so would be unlawful.
To the maximum extent permitted by law, Aesthete excludes liability for loss that is indirect or consequential and for loss caused by your unlawful conduct, misuse of a product, failure to follow instructions, failure to disclose relevant information, or a third party for whom Aesthete is not legally responsible.
Where liability may lawfully be limited, Aesthete’s liability will be limited to the remedies permitted by law. This clause does not exclude liability for personal injury caused by negligence or any other liability that cannot lawfully be excluded or limited.
23. Indemnity
To the extent permitted by law, you are responsible for loss reasonably incurred by Aesthete arising from your unlawful use of the website, infringement of another person’s rights, fraud, or material breach of these Terms. This does not require you to indemnify Aesthete for loss caused by Aesthete’s own negligence, breach of law or wrongful act.
24. Changes, Availability and Errors
Aesthete may update website content, services, practitioners, locations, prices and these Terms from time to time. Changes apply from the date they are published and will not retrospectively remove rights already accrued.
Aesthete does not guarantee that the website will always be available, uninterrupted, secure or error-free. Information may occasionally contain an error or become outdated. Aesthete may correct errors and update or withdraw content, subject to existing contractual obligations and applicable law.
25. Governing Law and Severability
These Terms are governed by the laws of Queensland, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Queensland and courts entitled to hear appeals from them.
If any provision is invalid or unenforceable, it will be read down or severed to the minimum extent necessary. The remaining provisions continue in effect.
